The following are the terms and conditions of SARL Basscamp-Festival, 1564 Route de Mont Evian, 74430, St Jean D’Aulps, France. Hereafter referred to as “Basscamp” “We”, “Our”, or “Us”. These terms and conditions relate to the rental of the Self-Catered Apartment as described on the website “morzineskiapartments.com”.

“You”, “your” “Party Leader” means you for yourself and on behalf of each and every member of your booked party (including anyone who is added or substituted at a later date).

Please read these conditions carefully as they form the basis of your holiday contract between Basscamp and you and all members of your Party on whose behalf the Party Leader is acting in all matters relating to this booking. The Party Leader will therefore be responsible for all monies due from the rest of the Party. A contract will only exist when Basscamp have received a completed and signed booking form and deposit, and Basscamp have sent confirmation of the booking and an invoice. We will ask you to sign your agreement to these booking terms and conditions on your accommodation Booking Form.

Making your booking.

To book the Apartment you must complete fully our booking form. This should be completed and signed by the Party Leader who must be at least 18 years of age at the time of booking. The Party Leader will act on behalf of the persons named on the booking form and will confirm the acceptance of these booking conditions. The Party Leader will also be responsible for all payments due in respect of the arrangements purchased. All payments for the Deposit and Final Balance for the Apartment on behalf of a Party must be paid by the Party Leader in one lump sum. Multiple payments from individual members of the Party cannot be accepted.

Once we have your booking form we will hold the booking for you for 7 days. A particular holiday date will only be booked for you once we have received both your booking form and your NON REFUNDABLE deposit payment of 500 euros in full. If booking 8 weeks or less before your arrival date you must make a full payment at the time of booking. Once we have received your booking form and all appropriate payments we will, subject to availability, confirm your holiday by sending you a booking confirmation e-mail and an invoice. The invoice will also include the final date by which your holiday balance must be paid. Please do check your confirmation letter and invoice carefully as soon as you receive them and raise any queries immediately. In addition to this, it is essential that you take out appropriate holiday insurance cover at the time of booking.

Your contract A binding contract between us comes into existence when we dispatch our confirmation letter and invoice to you. This contract and all matters arising out of it are governed by UK law.

The information and pricing on the morzineapartments.com website are indicated in good faith and believed to be correct.

Payment

As mentioned above, a NON-REFUNDABLE deposit of 500 euros must be made before we can confirm your holiday. For bookings made 8 weeks or less before your arrival date, full payment is required at the time of booking. The balance of the holiday payment must be received by us not less than 8 weeks prior to your arrival. After we have dispatched your confirmation and invoice, no further reminders will be sent. If payment is not received in full and on time, we reserve the right to treat your booking as cancelled by you. In this case the cancellation charges set out below will be payable.

We do not accept cash or cheques. Payment must be in Euros and may only be made by credit/debit card or internet bank transfer into our French Euro account. Credit/debit card payments will incur a charge of 1% taken in Euros on top of the quoted holiday price. You will be responsible for any charges imposed by your bank or card company, and any differences caused by exchange rate variations used by your bank or card company.

Security against damage, loss, breakages and additional cleaning charges.

We will ask you to provide details of a valid credit card on arrival at the property as security against damage, loss, breakages and additional cleaning charges as detailed in these conditions. By your agreement and acceptance of these Terms & Conditions, you are agree to allow Basscamp to charge that card in Euros for any damages, losses, breakages or additional cleaning charges that might occur.

In the event of the breakdown or defects of any appliances, machinery or equipment in the Apartment, or loss or damage to the property and/or its contents the client must inform Basscamp immediately for arrangements for repair or replacement to be made as soon as practicably possible. In the event that such damage to the apartment is learned of after your departure, we will contact you within 48 hours of your departure of the property to confirm any additional charges to be processed.

Prices

The prices on the Basscamp website are for the Apartment to accommodate up to a maximum of 4 guests sharing the apartment on a self-catered basis for 7 nights, with arrival and departure on a Saturday. (Apart from specified shorter breaks). There is no reduction should the number of guests be less than 4.

Included in the rental cost are pillows, duvets, bed linen and bath towels and toiletries for the number booked & cleaning at the end of your stay.

The maximum number of people allowed to stay in the Apartment must not exceed 4.

Furthermore, no guests other than those named on the Booking Form are allowed to stay in the Apartment under any circumstances. Noncompliance with this could result in your booking being terminated immediately and you and your Party being asked to vacate the Apartment immediately. No compensation will be paid as a result of this.

Pets.

No pets are allowed in the Property. 

The cost of your holiday arrangements.

We reserve the right to increase or decrease the prices of unsold arrangements at any time before your booking is confirmed. You will be given the correct current price of your chosen arrangements at the time of booking. Once your booking has been confirmed, we will guarantee not to surcharge any existing booking arrangements. This guarantee does not cover changes by you, which may add to the facilities or services you receive and which may involve additional costs.

Our prices do not include, airport transfers, flights or travel costs; travel, holiday or medical insurance; lift passes; childcare; equipment hire or lessons.

Insurance.

Winter and Summer Activities – Skiing, Snowboarding, Mountain Biking and other activities can be dangerous and all clients must be covered by an appropriate insurance policy. If you are likely to participate in other activities available in the resort (e.g. tobogganing, paragliding, or snow-mobiling etc.), please make sure the insurance includes full cover for all the activities that you and members of your Party may participate in.

It is the responsibility of you and all members of your Party to ensure the medical and travel insurance cover (including cancellation cover) is purchased and is suitable and adequate for your particular requirements. Basscamp cannot be responsible for your costs if you fail to do so.

Changes by you

Should you wish to make any changes to your arrangements after they have been confirmed, you must advise us in writing. Whilst we will endeavour to assist, we cannot guarantee we will be able to meet any such requests. Any alterations made to the existing booking, except, additions will be deemed to be a cancellation and the charges set out in this document will apply. It may also be necessary to levy a small non-refundable administration charge to process any alterations.

Cancellation by you

Should you or any member of your Party wish to cancel your holiday once it has been confirmed, the Party Leader who signed the booking form must immediately advise us in writing.

Cancellation charges will then be payable as set out below to compensate us for the cost of making your booking and the risk that we may be unable to re-sell your cancelled arrangements.

These charges are calculated from the date written notice of the cancellation is received by us as a percentage of the total price payable excluding any alteration charges if already charged which are non-refundable in the event of your cancellation.

The period before the start date of your holiday, within which written notification of cancellation is received by us, the cancellation charges are as follows:

Upon cancellation:

Your 500 euros NON REFUNDABLE deposit will be retained.

Cancellation charges are then apply as follows:

4-8 weeks before start date of your holiday – we retain 50% of the price of your holiday.

Less than 4 weeks before the start date of your holiday – we retain 100% of the price of your holiday.

Depending on the reason for the cancellation, you may be able to reclaim these cancellation charges under the terms of your insurance policy.

Alterations and / or cancellations by us

Due to circumstances beyond our control should it be necessary for Basscamp to make alterations to or cancel your booking we will contact you as soon as possible.

We reserve the right to make minor alterations to our website and our holiday details before and after bookings have been confirmed. In the case of a minor or significant alteration being made, we will advise you at the earliest possible date. In the event of a significant alteration, you may accept to cancel your holiday and receive a full refund. We will not pay any compensation in this instance. Very occasionally it may be necessary for us to cancel a confirmed holiday. We must reserve the right to do so. If we do so you will receive a full refund of all monies paid. We accept no legal liability and will pay no compensation.

Should we be forced to curtail your holiday after the date of arrival where circumstances amounting to ‘force majeure’ occur, as set out below. In this very unusual situation, we regret that we cannot make refunds, meet any costs or expenses you may incur as a result or pay any compensation.

Force Majeure

We regret Basscamp cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected by ‘force majeure’. In these booking conditions, ‘force majeure’ means any event which we or the supplier of the service(s) in question could not, even with all due care, foresee or avoid. Such events may include war or threat of war, riots, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and all similar events outside our control, such as, but not limited to, the temporary defect or stoppage of the supply of public services to the Property, or in respect of any appliances machinery or equipment in the Property. 

Our liability to you

We accept responsibility for ensuring that all parts of our contract with you are properly performed subject to the following exceptions. We cannot accept liability where any failure to perform or improper performance was due to:

  1. The act(s) and/or omission(s) of the person(s) affected or any member(s) of their Party or
  2. Those of a third party not connected with the provision of your holiday and which were unforeseeable or unavoidable or
  3. An event which either ourselves or the supplier of the services in question could not have foreseen or forestalled even with all due care.

Limits on Liability

Please note that we will not be liable for any injury, illness, or death or consequent losses suffered by you or any member of your party.

Conditions of suppliers

Please note that all services are provided subject to the conditions of the relevant supplier. Some of these conditions may limit or exclude the supplier’s liability to you, usually in accordance with the appropriate international conventions.

Check in/Check out

On your arrival day the accommodation will be available from 4 p.m. On your departure day you must be vacate the property by 10.00 a.m. Basscamp is not obliged to provide access before nor are you allowed to remain in the accommodation after the hours stated above.

On the day of departure all cars must be removed from the garage and designated parking spaces by 10.00 a.m.

Client liabilities, responsibility and behaviour

When you book a holiday with us, you accept responsibility for any damage or loss caused by you or any member of your Party. Full payment for any such damage or loss must be made at the time to ourselves or the third party concerned. If you fail to do so, you must indemnify us against any claims (including legal costs) subsequently made against us as a result of your actions. We expect all clients to have consideration for other people. Excessive noise after 10.pm will not be allowed. If in our reasonable opinion or in the reasonable opinion of any other person in authority you or any member of your Party behave in such a way as to cause or to be likely to cause distress, danger or annoyance to any third party or damage to property, we reserve the right to terminate the holiday of the person concerned without notice and ask them to leave the premises. In this situation, our responsibilities towards that person will immediately cease and we will not be responsible for meeting any costs or expenses they may incur as a result. We will not make any refunds or pay any compensation to the individual involved or to members of his/her Party or associates wishing to curtail their holiday as a result. 

Smoking and Illegal Substances

The Apartment is non- smoking. For health, insurance and safety reasons, smoking is strictly prohibited within the Apartment. If clients wish to smoke they must do so outside of these areas.

In the event of smoking related fires you and your Party accept responsibility for any damage. Additionally Basscamp reserves the right that if it is found that you or any of your Party has smoked within the Property you will be liable to a charge of up to 300 euros being deducted from your credit card for extra cleaning and removal of tobacco smells from the Property.

Similarly, smoking or taking illegal substances in or around the Apartment is forbidden and will result in any client involved being asked to immediately vacate the Apartment. Moreover, Basscamp reserve the right to refuse to continue to provide accommodation for your Party. No compensation will be payable.

Lost, Stolen and Damaged Property

Should you or any member of your Party not properly secure the exits or windows of the Apartment or garage, you will be liable for any Basscamp property stolen or damaged as a result of that negligence.

Furthermore, Basscamp will not be held responsible for any theft or loss of personal possessions or equipment of your Party from the Apartment or garage.

Each member of the Party is responsible for the safety of all their own personal possessions, documents and equipment within and outside the property including the garage made available.

Note. That this also applies to Mountain Bikes, Road Bikes, Ski/Snowboard Equipment and all other items and equipment that guests have hired or brought with them on holiday.

As it is a condition of your booking (and therefore reasonably assumed by Basscamp) that all guests have taken out appropriate insurance to cover such loss and/or damage. Basscamp cannot accept any responsibility or liability.

Any loss or damage to property, grounds, garages and outbuildings owned by or managed by Basscamp by the actions or activities of you or any members of your Party must be paid for in full. This is payable by the Party Leader, on behalf of the Party, irrespective of which person was responsible. This is to be paid to Basscamp before departure by the credit card payment details of which were supplied upon arrival as detailed above.

Additional cleaning charges, breakages and damage.

At the end of your stay you must ensure that:

All perishable food is removed from cupboards and fridge and disposed of.
All rubbish removed and taken to the dustbins;
The dishwasher to be emptied or on;
All bed linen stripped and left on each bed;
All towels to be left in the Bathrooms.

If the above requirements have not been followed before your departure from the property Basscamp reserves the right to charge up to 150 euros for any additional cleaning that may be required.

Do not dry any clothing, gloves etc. on the radiators. This is a fire risk and could also cause damage for which you will have to pay for.

Any damage caused to delicate, polished or metal surfaces, during your stay in the Apartment, as a result of cleaning products of an abrasive nature will be charged for.

The washing machine must not be used to wash shoes, trainers or unsuitable clothing and or extremely muddy clothing. All pockets must be emptied of coins and other items and materials which could damage the machine. You will be liable to pay for any repairs and parts or full replacement of the washing machine.

Lost Keys

The keys to the Apartment and building are security keys. The charge for a replacement key is €250 euros. This charge will be made immediately using the credit/debit card provided at the start of your holiday.

Children

Parents must ensure their children are supervised at all times. Particular care must be taken with stair cases as stair gates are not provided. Basscamp will not be held responsible for any accidents occurring within the property.

Outdoor shoes, Boots, Skis, Road, Mountain bikes & Equipment

All outdoor shoes, ski and snowboard boots, mountain biking, cycling shoes, walking shoes and boots are strictly forbidden anywhere inside the Apartment and the internal communal areas. Please ensure that you and your Party members include a pair of slippers or soft soled shoes in your packing.

All skis, snowboards, mountain bikes, road bikes, dirty or soiled and wet outdoor clothing and equipment must be kept in the area and/or garage provided and indicated by Basscamp.

The repair, maintenance and cleaning of any of the above items and equipment, waxing of skis or snowboards, is prohibited within the internal space of the property including the balcony.

Complaints

In the event you have a complaint you should notify us immediately. By raising complaints early, they can often be dealt with quickly so the rest of the holiday can continue to your satisfaction. Any complaints made on or after departure will not be considered.

We cannot accept liability if you fail to notify the complaint or claim entirely in accordance with this clause

Complaints cannot be accepted for airport transfers, snow conditions, childcare, weather, lessons and closures of ski – lifts and other services provided by third party suppliers or for anything outside of Basscamp’s direct control.

Third party services and activities.

Any suggestions or recommendation of services or activities supplied by third parties does not signify approval. Basscamp accepts no responsibility or liability for third party activities. Any complaints with third party services should be taken up directly with the provider.

Passport, visa and health requirements

We cannot accept any liability if you are refused entry onto a flight or into any country due to failure on your part to carry the correct passport, visa or other documents required by any airline or authority. Requirements may change and you should check the up-to-date position with the passport office and your doctor in good time before departure. Before traveling you are advised to check with your own doctor for your own medical requirements.
